## OVERVIEW

These Terms of Service, together with the policies referenced here (the "Terms"), explain your rights and responsibilities when using the Services or purchasing from Brickel. Please read them carefully, including the provisions concerning warranties, liability, and dispute resolution.

By using the Services or placing an order, you agree to the applicable Terms to the extent permitted by law. If you do not agree, please do not use the Services or place an order. Our Privacy Policy explains how personal information is handled; acknowledgement of that notice does not replace consent where consent is legally required.

Nothing in these Terms limits rights or remedies that cannot lawfully be excluded.

When you place an order, you make an offer to purchase. An automated order acknowledgement confirms receipt and does not by itself constitute acceptance. We may decline or cancel an order for a legitimate reason, including unavailable stock, a material pricing error, suspected fraud, payment failure, or inability to deliver to the address provided. If a proposed correction changes a material term, we will seek your agreement before proceeding.

Eligible returns and exchanges may be requested within **30 calendar days after delivery**, in accordance with our **Return and Exchange Policy** and applicable law. Purchases are intended for personal or household use unless we agree otherwise.

## SECTION 4 - PRICES AND BILLING

Prices, discounts, and promotions may change for future orders. The applicable price and currency will be shown at checkout and reflected in your order confirmation. Price changes do not alter an accepted order unless you agree or applicable law permits otherwise.

Shipping charges and any taxes or fees collected by us are displayed before payment. Any applicable import charges not collected at checkout will be disclosed for the order. Promotions may have additional conditions; where a specific promotion term conflicts with these Terms, that promotion term governs the offer concerned, subject to applicable law.

You agree to provide accurate and current purchase, payment, and account information and to update it when needed to complete a transaction or receive order communications. You must be authorized to use the payment method supplied and pay the charges you authorize at checkout.

## SECTION 5 - SHIPPING AND DELIVERY

Shipping costs **$2.99 USD** for orders with a merchandise subtotal below **$40.00 USD**. Orders with a merchandise subtotal of **$40.00 USD or more qualify for free shipping**. The threshold is calculated after discounts and excludes taxes and shipping charges. These rates apply to the shipping destinations available at checkout.

Orders are normally processed within **1–3 business days** after payment confirmation. Estimated transit time is **10–21 business days after dispatch**, giving an estimated total delivery time of **11–24 business days**. Business days are Monday through Friday, excluding applicable public holidays.

Delivery estimates may be affected by customs clearance, carrier disruptions, severe weather, or other circumstances. Any delivery deadline agreed for a particular order and mandatory consumer remedies continue to apply.

Please provide an accurate delivery address. If an order is delayed, missing, or damaged, contact **support@brickel.com** so we can investigate and arrange an appropriate remedy. The Services, including Brickel branding, text, images, graphics, video, audio, and the selection and arrangement of website materials, are owned by Brickel or used under permission from the relevant rights holders. You may access the Services for normal shopping and personal, non-commercial use. Except where permitted by law, you may not reproduce, distribute, modify, republish, commercially exploit, or create derivative works from protected materials without the appropriate rights holder's permission.

Brickel names, logos, and other brand elements may not be used without authorization. Shopify names and logos belong to Shopify. Other trademarks remain the property of their respective owners. New features or tools introduced as part of the Services will be subject to the applicable Terms and any additional conditions disclosed for them.

The Services may include links to independent websites or third-party content. We do not control the independent content, policies, or practices of those websites. A link does not necessarily mean that Brickel endorses the third party.

Review the relevant terms and privacy notices before using an independent service or making a purchase from a third party. Questions about an independent third-party transaction should be directed to that provider. Any limitation of our responsibility applies only to the extent permitted by law.

## SECTION 9 - RELATIONSHIP WITH SHOPIFY

Where a limitation is not permitted in your jurisdiction, your applicable legal rights prevail.

We will not agree to a settlement imposing obligations on you without your consent where required by law.

## SECTION 18 - SEVERABILITY

If a provision is found unlawful or unenforceable, it will apply only to the extent legally permitted or be severed as appropriate. The remaining provisions continue to apply where legally possible.
